A workplace accident can trigger administrative, civil and criminal consequences for an employer at the same time. What is done in the first days shapes everything that follows.
1. Response and safety
The priority is getting the injured person to medical care and making the site safe to prevent another accident. Where possible, the scene should be preserved until it has been examined.
2. Notification
The accident must be reported to the Social Security Institution within three working days (Law No. 5510, Article 13). Late notification has serious consequences in terms of administrative fines and recourse claims by the Institution.
Documents gathered in the first hours are the strongest evidence in compensation proceedings that may last years.
3. Minutes and evidence
Witness statements, camera footage, health and safety training records, the risk assessment and records of personal protective equipment issued should be secured immediately.
4. Legal assessment
Legal advice is recommended before employees and managers give statements in a criminal investigation. Establishing the causes through an internal inquiry and documenting corrective measures both prevent future accidents and matter when fault is apportioned.
