International arbitration is a dispute resolution mechanism through which disputes arising from commercial and contractual relationships involving a foreign element are resolved by arbitrators rather than state courts. The scope and validity of arbitration agreements, the determination of the seat of arbitration, the applicable procedural rules and the conduct of arbitral proceedings are among the principal subjects addressed in this field.
International arbitration proceedings are assessed in light of the nature of the dispute and the applicable legal framework. In Türkiye, the International Arbitration Law No. 4686 is one of the principal legislative instruments where applicable. Relevant international conventions and institutional arbitration rules may also need to be considered in each case.
Where an arbitral award is intended to produce legal effects in Türkiye or another jurisdiction, issues concerning its recognition, enforcement or enforceability under the applicable legal framework may require separate assessment. Relevant international conventions and domestic legal rules are taken into account in determining the appropriate procedure.
